ACCEPTANCE OF TERMS THROUGH USE.  The Terms of Use state the “Terms and Conditions” under which you may use WantContractors.com.  Please read this information carefully.  This web site is offered to you, conditioned on your acceptance without modification, of the following terms, conditions, and notices contained in this agreement (the “Terms and Conditions”).  Your use of this web site indicates your acceptance to be bound by the Terms and Conditions and constitutes your agreement to all such terms, conditions, and notices in effect at such time.  If you do not accept the Terms and Conditions stated here, do not use this web site and/or services.

DESCRIPTION OF SERVICES.  At WantContractors.com we are committed to making your total experience a positive one.  WantContractors.com is an online networking resource to match project posters to a qualified contractor or service provider.  The WantContractors.com web site is also a resource to help facilitate the bidding process.  Once a project poster has entered his/her information and the project poster request, WantContractors.com will automatically match each project to the appropriate service providers in the vicinity, if any, who may be able to fulfill the requested service need.

However, we do not guarantee that we will be able to match your service needs with a contractor/service provider or that there are contractors/service providers in your area that are capable or willing to complete your service request.  Although we take certain measures to examine the qualifications of our listed service providers, we make no guarantees regarding the skills or representations of such service providers or the quality of the job that he/she may perform for you if you elect to retain their services.  Nor does WantContractors.com endorse or recommend any particular contractor or service provider.  It is entirely up to you to enter into a direct contract or otherwise reach agreement with a service provider, and we do not guarantee or warrant their performance on the job or the outcome or quality of the services performed.  Contractors and service providers listed on WantContractors.com are not employees or agents of WantContractors.com, nor is WantContractors.com an agent of these service providers. 

WantContractors.com does not perform, and is not responsible for any of these services requested by you in your posted project.  Your rights under contracts you enter into with service provider are governed by the terms of such contracts and applicable federal, state, provincial and local laws.  Should you have a dispute with the service provider directly, YOU HEREBY AGREE TO RELEASE WANTCONTRACTORS.COM (AND OUR OFFICERS DIRECTORS, AFFILIATES, EMPLOYEES AND AGENTS) AND ANY OTHER PERSON, FIRM, OR ENTITY (INCLUDING OUR BUSINESS PARTNERS) FROM ANY DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OF EVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, AND DISCLOSED OR UNDISCLOSED, ARISING OUT OF OUR SERVICES IN ANY WAY CONNECTED WITH SUCH DISPUTES AND YOUR DEALINGS WITH SERVICE PROFESSIONALS.

(WantContractors.com provides the service of connecting project posters to contractors and service providers.   You understand and agree that the WantContractors.com service may include advertisements and that these advertisements are necessary for WantContractors.com to provide the Service. You also understand and agree that the Service may include certain communications from WantContractors.com, to include but not limited to administrative messages, the WantContractors.com Newsletter, service announcements and that these communications are considered part of your WantContractors.com membership and You will not be able to opt out of receiving them.  Any new features that enhance or augment the current Service, including the release of new WantContractors.com properties, shall be subject to the Terms and Conditions, unless explicitly stated otherwise. You understand and agree that the Service is provided "AS-IS" and that WantContractors.com assumes no responsibility for the failure to store, deletion, timeliness, or mis-delivery of any user communications or personalization settings. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.

DISCLAIMER OF WARRANTIES OR LIABILITY.  WantContractors.com cannot guarantee the work performed by a listed service provider and we have no obligation to you with regards to the relationship between a project poster and a service provider.  WantContractors.com is not involved in the actual transaction between service provider/contractors and the individual requesting their services. As a result, the WantContractors.com has no control over the quality, safety or legality of their work or information posted, the truth or accuracy of the listings, the ability of a “project poster” to offer job opportunities or the ability of a contractor to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through the WantContractors.com web site.

WantContractors.com can not confirm user authentication and does not confirm that each user is who they claim to be. WantContractors.com is not involved in user-to-user dealings, nor can we control the behavior of participants on the WantContractors.com web site.  In the event that You have a dispute with one or more users, You release the WantContractors.com (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If You are a California resident, You waive California Civil Code d1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

We are under no legal obligation to, and generally do not, control the information provided by other users which is made available through the WantContractors.com web site. By its very nature, other people's information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled.

THE COMPANY MAKES NO WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE WEB SITE CONTENT, SERVICES, SOFTWARE, TEXT, GRAPHICS, AND LINKS.

WANTCONTRACTORS.COM MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOU EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

THE COMPANY DOES NOT WARRANT THAT THE WANTCONTRACTORS.COM WEB SITE WILL OPERATE ERROR-FREE OR THAT THE WANTCONTRACTORS.COM WEB SITE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL. IF YOUR USE OF THE WANTCONTRACTORS.COM WEB SITE OR THE WEB SITE CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, THE COMPANY IS NOT RESPONSIBLE FOR THOSE COSTS.

PRIVACY POLICY.  WantContractors.com is committed to protecting your privacy. Upon your registration, you may choose your own user ID and password in order to access Want Contractors services through the WantContractors.com web site.  You will also be prompted to disclose certain information about yourself or company and your service requirements or specialties.  Any information collected is for the purpose of matching individuals seeking a service professional/contractor with the desired service professional/contractor requested.  We will not sell, trade or rent your personal information to a third party without your permission.  Some of this information will be available to service professionals and/or project posters who will need this information to respond to you or to other persons or entities in connection with our business.

By providing this information to us, or by submitting a service request, you are requesting, and you expressly consent to being contacted by us and by our service professionals and providers via phone, fax, email, mail or other reasonable means, at any of your contact numbers or addresses, even if you are listed on any federal, state, provincial or other applicable “Do Not Call” lists, in order that we may provide the services set forth on our site, to service you account, to reasonably address matters pertaining to your account or for other purposed reasonably related to your service request and our business, including marketing related emails.  We may send you offers through email or otherwise which we deem relevant to your specific trade(s).  In the course of your WantContractors.com membership, you expressly consent to being contacted by us in order to provide the services set for the on our site, to service your account, to address matters pertaining to your account, or for other purposed related to our business.  You agree that by completing a service request, you are entering into a business relationship with WantContractors.com and thus agree to be contact by WantContractors.com

WantContractors.com does not control the privacy policy of third parties who use our service.  A third party may have a privacy policy that is different from that of WantContractors.com.  In these instances, data that you submit to our service via a third party may be shared by that party.

REGISTRATION, PASSWORD AND SECURITY.  In consideration of Your use of the Service, You agree to: (i) Provide true, accurate, current and complete information about yourself and/or company as prompted by the registration form and; (ii) Maintain and promptly update the Registration Information to keep it true, accurate, current and complete. You will receive an account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under Your password or account. You agree to (i) immediately notify WantContractors.com of any unauthorized use of Your password or account or any other breach of security, and (ii) ensure that You exit from Your account at the end of each session. The WantContractors.com Web Site may be used only for lawful purposes by individuals seeking a service professional/contractor and for service professionals/contractors seeking employment/contract opportunities. The Company specifically prohibits any use of the Web Site, and all users agree not to use the Web Site, for any of the following:

         I.    Posting any incomplete, false or inaccurate information or information which is not your own. 

        II.    Deleting or revising any material posted by any other person or entity.

      III.    If you have a password allowing access to a non-public area of this Web Site, disclosing to or sharing Your password with any third parties or using Your password for any unauthorized purpose.

       IV.    Upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;

        V.    Harm minors in any way;

       VI.    Impersonate any person or entity, including, but not limited to, a WantContractors.com representative or falsely state or otherwise misrepresent Your affiliation with a person or entity;

     VII.    Manipulate identifiers in order to disguise the origin of any Content transmitted through the WantContractors.com website.

   VIII.    Upload, post, email, transmit or otherwise make available any Content that You do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

        X.    Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose;

       XI.    Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

     XII.    Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

   XIII.    Provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;

    XIV.    "Stalk" or otherwise harass another;

      XV.    Using any device, software or routine to interfere or attempt to interfere with the proper working of the WantContractors.com Website or any activity being conducted on this site.

    XVI.    Taking any action which imposes an unreasonable or disproportionately large load on the WantContractors.com Website's infrastructure.

  XVII.    Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the WantContractors.com Website.

 XVIII.    Aggregating, copying or duplicating in any manner any of the Web Site Content or information available from the WantContractors.com Website.

SUBMISSIONS & LISTINGS. 

As a user and member of WantContractors.com, you are responsible for your own communications and are responsible for the consequences of your posting. You must not, and by using the WantContractors.com web site You agree not to, do the following things: post material that is copyrighted, unless You are the copyright owner or have the permission of the copyright owner to post it; post material that reveals trade secrets, unless You own them or have the permission of the owner; post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others; post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity; post material that is off-topic on topic-specific message boards; post a sexually explicit image or statement; post advertisements or solicitations of business, post chain letters or pyramid schemes; impersonate another person; or post material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.

The Company does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by WantContractors.com or submitted to WantContractors.com, including without limitation information in the WantContractors.com web site. You acknowledge that any reliance on material posted by other users will be at your own risk.

WantContractors.com acts as a passive conduit for the online distribution of user-submitted information and may or may not pre-screen Content and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users.

WantContractors.com and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the WantContractors.com web site service. Without limiting the foregoing, WantContractors.com and its designees shall, at its sole discretion, have the right to remove any Content that violates the Terms and Conditions or is otherwise objectionable. The Company has no liability or responsibility to users for performance or nonperformance of such activities. You may not attempt to override or circumvent any of the usage rules embedded into the Service. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the Service, in whole or in part, is strictly prohibited.

WantContractors.com has no control over such sites and resources and you acknowledge and agree that WantContractors.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that WantContractors.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

DISCLAIMER OF CONSEQUENTIAL DAMAGES.  YOU EXPRESSLY UNDERSTAND AND AGREE THAT IN NO EVENT SHALL THE COMPANY, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON THE WANTCONTRACTORS.COM SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT ,INCIDENTAL, SPECIAL,CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE DATA OR OTHER INTANGIBLE LOSSES OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE CREW4CREW SITE AND THE WEB SITE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

LIMITATION OF LIABILITY.  WANTCONTRACTORS.COM’S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE WANTCONTRACTORS.COM SITE OR YOUR USE OF THE WEB SITE CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $100.

INDEMNITY.  You agree to defend, indemnify and hold harmless WantContractors.com, its officers, directors, employees, subsidiaries, affiliates, agents, co-branders and/or other partners, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from any third party due to or arising out of any Content You submit, post, transmit or make available through the Service, Your use of the Service, Your connection to the Service, Your violation of the Terms and Conditions, or Your violation of any rights of another.

GENERAL PRACTICES REGARDING USE AND STORAGE.  You acknowledge that WantContractors.com may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that registered data, messages, message board postings or other uploaded Content will be retained by the Service. You agree that

WantContractors.com has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by our Service. You acknowledge that WantContractors.com reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that WantContractors.com reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

TERMINATION.  You agree that WantContractors.com may, under certain circumstances and without prior notice, immediately terminate Your membership account and access to the Service. Cause for such termination shall include, but not be limited to, (i) breaches or violations of the Terms and Conditions or other incorporated agreements or guidelines, (ii) requests by law enforcement or other government agencies, (iii) the Company's inability to verify or authenticate any information You submit to the Web Site or other WantContractors.com registration, (iv) a request by You (self-initiated account deletions), (v) discontinuance or material modification to the Service (or any part thereof), (vi) unexpected technical issues or problems, and (vii) extended periods of inactivity. Termination of Your membership account includes (i) removal of access to the Service, (ii) deletion of Your password and all related information, files and content associated with or inside Your account (or any part thereof), and (iii) barring further use of the Service. Further, You agree that all terminations for cause shall be made in WantContractors.com sole discretion and that WantContractors.com shall not be liable to You or any third-party for any termination of Your account.

MODIFICATIONS TO SERVICE.  WantContractors.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the WantContractors.com web site (or any part thereof) with or without notice. You agree that WantContractors.com shall not be liable to You or to any third party for any modification, suspension or discontinuance of the Service.

REFUND POLICY.  Refunds will not be granted under the following circumstances:  (i) if a registered user decides to terminate registration prematurely; (ii) if a registered user feels dissatisfied with the service as laid down in the Terms of Service.

Refunds will be granted only under the following circumstances: (i) if an user’s registration/profile has been deleted for no reason or by accident, he/she may either have his registration re-established or receive a refund. In either case the refund shall be proportional to the remainder of the registration period; (ii) if the service to the employer, as laid down in the Terms of Service, is non-functioning for more than 14 days in any one period then the registered user shall notify WantContractors.com of this failure by E-mail.  If after 7 days from receipt of the E-mail by WantContractors.com the service has not been re-established then a refund will be granted proportional to the remainder of the registration period.

In order to claim a refund, contact WantContractors.com by E-mail.  This E-mail must state your reason for claiming a refund.  Any refund will be paid within a one-month period after WantContractors.com has confirmed by E-mail that a refund is valid. 

GENERAL INFORMATION

The Terms and Conditions constitute the entire agreement between You and WantContractors.com and govern Your use of the Service, superseding any prior agreements between You and WantContractors.com with respect to the Service.
The Company makes no claims that the Web Site Content may be lawfully viewed or accessed outside of the United States. Access to the Web Site Content may not be legal by certain persons or in certain countries. If You access the Web Site from outside of the United States, You do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms and Conditions are governed by the internal substantive laws of the Commonwealth of Florida, without respect to its conflict of laws principles. Jurisdiction of any claims arising under this agreement shall lie exclusively with the state or federal courts within Tallahassee, Florida and/or the courts located within the county of Broward, Florida. The failure of Crew4Crew to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.
